Terms of service
These terms apply when you use The Poker Director, with or without an account, and when you buy a paid plan. They are written to be read. The part most people want is how paying, renewing and cancelling work - that's sections 4 to 7.
1. Who we are
The Poker Director (thepokerdirector.com) is the service these terms are about. You can reach us about anything in these terms at hello@thepokerdirector.com.
2. Using the site
- Without an account you can run and share a live clock; it is deleted 48 hours after it was created. With a free account your games are saved in your hub. Either way, these terms apply.
- You're responsible for your account and for keeping your password to yourself.
- You must be at least 18 to buy a paid plan.
3. Poker, money and the law
The Poker Director is a tool for running a game: a clock, a list of players, a record of results. We don't organise, host or take part in any game, and we never handle any money for one - buy-ins, prize pools and payouts shown on the site are numbers you type in, for your own record. Where you live, running a poker game, and playing for money, may be regulated. Making sure your games are legal is up to you.
4. Plans and prices
- Free costs nothing and has no time limit.
- Plus and Club are subscriptions, each billed either monthly or yearly. The prices in the Manage plan window include VAT where VAT applies. Checkout may show the price converted into your own currency.
What each plan includes is listed next to its price. We keep improving the site, so features may be added or changed; we won't take away something central to a plan you've paid for during the period you've paid for.
5. A paid plan starts at once - the 14-day right of withdrawal
When you buy online in the EU you normally have 14 days to change your mind. For something digital that you ask to start straight away, that right can end once it starts - if you asked for it to start and confirmed that you know you lose the right.
A paid plan starts the moment your payment goes through. Before you can go to checkout - or upgrade from Plus to Club, or switch from monthly to yearly billing - the Manage plan window asks you to tick a box: by ticking it you ask for the plan to start as soon as you pay and confirm that you understand that you thereby lose your 14-day right of withdrawal. We record when you ticked it with your subscription, and straight after you've paid we email you a confirmation that repeats it.
So we don't refund the first payment for a new subscription, or the payment for an upgrade or a switch to yearly billing, because you changed your mind. You can still cancel at any time so that it doesn't renew - see section 7.
If, despite this, the law that protects you gives you a right to withdraw, tell us within 14 days of subscribing and we'll do what that law requires - which, for a service you asked to start at once, is usually a refund of the part of the period you haven't used.
6. Payment and renewal
- Payments are handled by Link, the checkout of our payment provider Stripe, which sells the subscription to you on our behalf as the seller of record. That's why your receipts and invoices come from Link and your card statement shows "LINK.COM*". Link works out and pays the VAT. We never see your card details.
- A subscription renews automatically at the end of each month or year, and your payment method is charged the same price, until you cancel.
- If we ever change the price of your plan, we'll email you at least 30 days before it applies to you, so you can cancel first if you don't want to pay the new price.
- If a renewal payment fails, it's tried again over the following days. While it's unpaid, your account works as a Free account; your plan comes back as soon as the payment goes through. Nothing you've saved is deleted.
- Changing plan. Upgrading from Plus to Club starts Club at once: you pay the difference between the two for the rest of the period you've paid for straight away, with the payment method on your subscription, and the subscription then renews as Club. Switching from Club to Plus takes effect at the end of the period you've paid for: Club stays open until then, and the subscription renews as Plus. Until then you can keep Club at no charge.
- Changing how you're billed. Switching from monthly to yearly billing starts a new year at once: you pay the yearly price straight away, less the part of the month you've paid for but not used, with the payment method on your subscription, and the subscription then renews every year from that day. Switching from yearly to monthly takes effect at the end of the year you've paid for: nothing is refunded for that year, and the subscription then renews every month. Until then you can keep yearly billing at no charge.
7. Cancelling and refunds
- You can cancel whenever you like: open Manage plan in your hub, then Manage subscription. You can also cancel, or update your card, on link.com.
- When you cancel, the subscription doesn't renew. Your plan stays open until the end of the period you've already paid for, and then your account becomes a Free account.
- We don't refund the unused part of a period when you cancel - except where section 5's last paragraph applies, where the law requires it, or where we're at fault (for example, if the service stops working for a long time, or we end your plan without you having broken these terms). Then we refund the unused part. You can ask us, or Link's support, about a payment.
8. Going back to Free
When a paid plan ends, nothing you made is deleted. Your games, tournaments, clubs and structures stay; features that need your old plan become read-only or locked until you subscribe again, and new games follow the limits of the plan you're on. The same goes for Club's features when Club becomes Plus.
9. How to behave
Don't use the site to break the law, and don't:
- post anything unlawful, hateful, harassing, sexually explicit or that infringes someone else's rights;
- post spam or advertising, or pretend to be someone else;
- try to get into other people's accounts or games, or to break, overload or scrape the site.
Moderators may remove posts that break these rules and may mute accounts that keep doing it. For serious or repeated breaches we may suspend or close an account. If we close an account with a paid plan for this reason, we don't refund the rest of the period.
10. Your content
What you create on the site - games, structures, posts - stays yours. You let us store it and show it to the people you share it with (or, for forum posts and public profiles, to the people described in our privacy policy) for as long as it's on the site. That's all we use it for.
11. Availability
We work to keep the site running and your data safe, but we can't promise it will always be available or free of errors. We may need to take it down for maintenance now and then. A live clock depends on your devices' internet connections as well as ours.
12. Liability
Nothing in these terms limits liability that the law doesn't allow to be limited, and nothing takes away your rights as a consumer. Beyond that, we're not liable for indirect or unforeseeable losses, and our total liability to you is limited to what you paid us in the 12 months before the claim.
13. Closing your account
You can ask us to delete your account at any time by emailing hello@thepokerdirector.com. Cancel a running subscription first (see section 7). What happens to your data is described in the privacy policy.
14. Changes to these terms
We may update these terms. If a change matters to you, we'll email you before it takes effect. For a paid plan, a change that affects it applies from your next renewal - if you don't agree, cancel before then.
15. Complaints and the law
If something is wrong, email hello@thepokerdirector.com first - we'll try to put it right. If you're a consumer, you keep the protection of the mandatory consumer law of the country you live in, and you can take a complaint to a consumer complaints body or court there.
